The Mandate

The parliament resumes today after almost a month and a half break. There has been so much talk about when Pakatan will take over and the new leadership which is iminent with the Barisan Nasional government. If you listen to some of the speeches by the Barisan leaders, its almost certain that Najib will be the PM and Muhyiddin will be the DPM. Some must have forgotten that there is a whole electoral process that has got to be undertaken before the decision is given.

keADILan Open House 12th October 2008

Dato Seri Anwar Ibrahim and the leaders of Parti keADILan rakyat had they Hari Raya Open house today at the  Club Sultan Sulaiman, Kampung Baru. The event started about 2pm and is expected to go on till about 5pm today. The lrt was the best bet of transportation since a large crowd was expected and its only about a 10minutes walk fron the lrt station.

Getting there from the Kampung Baru lrt station is no trouble at all, you simply have to follow the crowd and you will be directed to the venue of the event. I’m not going to go into details but post all the pictures which i managed to take.I had some views thanks to some “friends” who got me in ;)

How a Prime Minister Is Choosen

Ever wondered how a prime minister is decided? With Najib,Badawi,Anwar and now even Ku Li after the hot seat, the below article gives you a idea of the posibilities of how a prime minister can be elected based on circumtances.

EVEN as opposition leader Datuk Seri Anwar Ibrahim stumbled in his quest to unseat the government by 16 Sept 2008, the likelihood of a change in government lingers palpably. Questions now abound about how exactly Anwar can achieve forming the next government.

Some legal experts have said a vote of no-confidence in Parliament against the sitting prime minister, Datuk Seri Abdullah Ahmad Badawi, is the Pakatan Rakyat leader’s only recourse.

Lawyer Tommy Thomas tells The Nut Graph what methods are constitutionally available for a change of premier. The constitutional lawyer explains the legal principles involved, stressing that blocking a vote of no-confidence in Parliament against the prime minister — which has happened twice already — is unconstitutional, as are attempts to detain Anwar or any other member of parliament (MP) at this juncture.

TNG: What are the legal principles established by the three cases: Stephen Kalong Ningkan (1966); the Privy Council case (Nigerian case: Adegbenro vs Akintola in 1963); and 1994′s Datuk Amir Kahar Mustapha vs Tun Mohd Said Keruak, which involved former chief minister of Sabah Datuk Joseph Pairin Kitingan resigning from his post?

Tommy Thomas: The legal principles established by the cases are this: In the Stephen Kalong Ningkang case, the court said, the only way to test confidence is by a lower house vote. That is the legal principle. So it is confined to one method only. In the Privy Council case from Nigeria and the Pairin Kitingan case, there was no lower house vote. Yet the courts said in both cases, the governor acted correctly. That’s the principle to be drawn.

So the three reported cases we know of [involved] governors (the Sabah and Sarawak Yang diPertua’s powers are similar to a governor’s). Yet none of them is the decision of the head of state or a constitutional monarch. I personally know of no [such] cases.

Keadilan Press Release :Badawi: Wading back from the Rubicon

Thank God, Theresa Kok has been released from the ISA. The Badawi administration’s lame excuse of not finding any reason to detain her further sounds as ludicrous as Tan Hoon Cheng’s detention is for her protection. Unfortunately, Raja Petra is still detained. Since the crack down began last week, mosques, churches, temples, places of worship and all other places where the public congregate, have seen vigils and prayers for the three detainees and for our country. All religions have in the course of their development been victims of oppression. They are therefore familiar with OPPRESSION and are quick to recognize   one when it happens. But there is a word that is more appropriate than oppression to describe the sinful act of the Badawi administration in the misuse of the ISA, it is TYRANNY! [Read more...]

No Walk To Palace

A poster has been seen around indicating a walk to the palace today organized by PKR.  The party confirmed that this is not something that was organized by them and is by certain individuals who are trying to pull of some stunt.
